Women Winning statement on the Supreme Court adding a case disputing access to Mifepristone to the docket

Saint Paul, Minn. (December 13, 2023) – Today, the United States Supreme Court announced its intention to add Alliance for Hippocratic Medicine vs. U.S. Food and Drug Administration to the Supreme Court docket, setting up a potential battle for access to the medication abortion drug Mifepristone at the federal level.

“Post-Roe, the Federal Government maintains a neutral stance on the legality of abortion, allowing states to either safeguard or restrict access based on individual state law. Given that the FDA operates as a federal entity, any ruling in this case would have nationwide implications for every state in America,” said Women Winning Political Director Britta Moen. “This case could create a wide variety of implications, including the potential decision to prohibit the use of Mifepristone, affecting its legality in every state, even in those like Minnesota where abortion is legally permitted.”

“We urge the United States Supreme Court to listen to Americans and the FDA, and reject the extremists that seek to end bodily autonomy for pregnant and birthing people,” said Women Winning Executive Director Nevada Littlewolf. “More than half of abortions in the United States utilize medication like Mifepristone, which is a safe and effective means of ending a pregnancy. There is no historical precedent for reversing FDA approval, and there is no justification for establishing such a precedent at this time.”
